In all likelihood you have been served with a complaint and summons in a small claims case. You must transmit the papers you have received (make sure you keep a copy for yourself) to the insurance company you had in 2004. You must do this immediately and without delay--otherwise, your insurance company will refuse coverage based on your non-cooperation and any judgment entered against you will have to come out of your own pocket.

Give all of the documents to your insurance company or insurance agent - not your insurance "broker".

The name of the insurance company will be on the policy documents - Allstate, State Farm, GEICO, etc.

If you purchased sub-standard insurance like Safeway, Universal Casualty, Apollo, American Ambassador, Gallant, etc. then you should send the documents to that company by certified mail, return receipt requested so they don�t �lose� them.

Good luck and remember that there is nothing to worry about at all - this is why you purchased insurance.

You have an obligation to inform them of the lawsuit and then cooperate with the litigation. (It is important that you respond to their letters and keep them updated with your current address.)

They have an obligation to defend you in the lawsuit and pay for the damages up to the amount of the policy you purchased.
