Legal Question in Personal Injury in Illinois

I recived a summons in the mail saying I hit someone in the head with a glass which I did not. I was questioned by the police but was not arrested or charged with anything. this happened in Nov 09. Can i use a public defender for this? I cannot afford an attorney and how can they say it was me when i was not charged or arrested for this?

You are most likely being sued in Civil Court.

A Public Defender is not available in Civil Court. You are most likely being sued for monetary damages and are most likely not facing any jail/prison time.

You will want to hire an attorney to defend yourself.

The plaintiff is most likely seeking a judgment against you.

No, you may not use a public defender in a civil action-which from the dates of the event sounds like it was filed in November 2011.

Whether you agree with the content of the complaint or not, you have to respond to it--otherwise, everything contained in it will be deemed as accepted by you and a monetary judgment will be entered.

You have only 28 days from the date you were served by which to file an answer... You must move quickly!
