small claim

my neighbors dog bit my daughter incurring a bill for $577.00 - they refuse to pay the bill. What can I do?

If your child was bit without having provoked the dog, you can sue your neighbor for recovery of your damages. If your child has sustained any scaring, any possible future expenses including possible plastic surgery, you should consider all that as your damages.

Does your neighbor has insurance?

Does he own his home?

Direct answer to your question is that your neighbor is responsible for damages caused by his dog.

Even if your child provoked the dog, it does not mean you have no case. You can sue your neighbor in small claims court.

You can file a case on behalf of your child for personal injury, which would include medical expenses as well as well as other damages such as pain and suffering, and a separate claim on your behalf for the bill. If the child has permanent injuries such as scarring, the damages could be significant.
