Legal Question in Personal Injury in Illinois
My son was attacked inside his high school during after hours at a basketball game. No one would come forward as a witness and my son could not identify the boy during a line up, so the judge dismissed the case for lack of evidence.
According to my son, words were exchanged between him and another boy from a different school. As he walked off, another boy, from the same school, hit him. He had to undergo constructive dental surgery, where 8-10 teeth were knocked out/out of socket, and he lost 2 teeth altogether.
I or my son have not been compensated for our losses. The school failed to provide sufficient security for the game, secuirty cameras were off (so I was told), and no one was patroling the hallways, which is where the incident occurred. Can I sue his school?

You also have to comply with the applicable statute of limitations and possible rules relating to damages limitations when you sue a school. You can also consider suing the individual who injured your son. Chances are you could win in spite of the lack of a conviction.
