Legal Question in Personal Injury in Illinois

My son was struck by a vehicle while riding his bike in Chicago. He was not injured but his bike was damaged. The woman who was driving gave him her phone number and said she would pay to repair the damage. He has the receipt for the $250.00 worth of repair. When he contacted her, she refused to pay and said that was "too much". Unfortunately, no police report was filed. Any recourse?

Sue her, and file a police report next time. In fact, you should contact the police for this one too. They might not be interested since some time was passed, but there should be a record of this for the next time she hits a cyclist or pedestrian.

Lucky she did not damage one of my bicycles, she would think your $250 is a real bargain--which it is actually.

Yes. First, file a police report so that there would be an official record of the event. If you have the plate number of the vehicle you can find the insurance information of the person from IDOT and then make a claim directly with her insurance.

If you do not, you will have to file a lawsuit and then get it that way.

I agree. Try to file a police report now. You also can go around her, by finding out who her insurer is, and talking directly with them.

I also agree. File the police report. You should also try to track down any potential witnesses who might have seen the accident now, while the matter is fairly recent.
