During the taikondo sparing, my son was injured by a poweful kick from another student.
I would like to know in that case, was it an accident or an injury?
What can I do?
We have been through a major sugery and pain.

Where did this happen? Was it during a class for which you had signed up? If so, in all likelihood you have signed away you right to sue in case of an injury.
If it was not during a class, and just two kids fighting, you may have a cause of action for assault and battery.
If the fight was a friendly one that got a bit out of hand, in all likelihood you will not prevail if you bring a case because your son had assumed the risk by engaging in that dangerous activity.

ANSWER:
I've handled this exact case before and it depends on whether the "powerful kick" was foreseeable at the time you signed the release of liability.
If it occurred before or after class, on or off the mat, within the direction of the instructor or not - all makes a difference.
