Statute of limitations on personal injury claim

A co-worker's son was severly burned at a former place of employment because of negligance on their behalf. They had a large kettle of boiling water on the back dock and the child fell in to the scalding water and was severly burned over his entire body except for his hands, feet and head. He has undergone @ 13 surgeries. Does she have any options or has time run out?

Dear Sirs:

Normally the statute of limitations is two (2) years from the date of injury and three (3) years for a workmen's compensation claim.

You do not give enough information as to when this event take place. I also need to know how old is the child. I also need to know what was she doing before the injury and a lot more information about where was the kettle, how big, how dip, any signs, what was it used for, why the child was near the kettle etc... etc...

What a horrible experience!! I can not imagine the pain and agony that he has gone through! Burns are so painful! The good news is with few exceptions, the statute of limitations in Illinois for children begins to run when the child reaches age 18.

I need to know more facts about the tragedy before I can render an opinion on options. I have cases throughout Indiana and Illinois and would be willing to meet your coworker, his family and child at their place of residence if that is convenient.

I hope that this information may bring them some hope.

You do not say when the accident happened, nor how old the child was/is, so it is impossible to accurately answer the question.

If the child is now not 20 then the odds are that the claim is still alive but you would need to provide more fact-specific details, in order to be sure.

You should have your co-worker call or email an attorney wihtout delay.

I had a very similar case involving a coffee urn that overturned when a child was running and tripped over the cord pulling the coffee over on top of him requiring extensive skin graft surgeries.

Contact an attorney immediately. Typically you will have 2 years after the minor's 18th birthday to file suit. The statute of limitations may be less in some instances. Don't wait any longer.
