Legal Question in Personal Injury in Illinois

statute of limitations and timing

I was in an auto accident 3/01 and do not plan to hire an attorney to recover my medical and pain and suffering. I am working with the insurance company. If I want to hire threaten to hire an attorney in order to get them to move quicker on my case, what is the statute of limitations in Illinois? Also, They are dragging their feet on making me an offer even though I wrote them a demand letter and got all the records they requested. How can I pursuade them to move this along?

Re: statute of limitations and timing

You know that you have every right in the world to handle your own claim against the insurance company. You apparently don't know that you are making a mistake in doing so. When I interview personal injury clients, I gather all of the information I can, and then I make a judgment call. If I can serve that injured person by obtaining for him or her a larger amount of compensation from the insurance company after my contingency fee is deducted than he or she would have obtained without my services, then I will take the case. If the injured person would wind up with more money handling the claim without legal counsel, then I decline the representation. You are apparently experiencing some difficulty in handling the claim on your own, and you are seeking free legal advice on this bulletin board to help you obtain a settlement without having to pay an attorney for the value of legal services. I strongly feel that you should hire an attorney to represent you to be sure that you receive everything to which you are entitled, and that the attorney should be fairly compensated for his or her services to you.
