Most lawyers will not attempt to settle an injury case until the client has completed treatment. This way, the attorney has all the bills and medical records in order to assess the value of your claim. Please be aware that in Illinois the statute of limitations is generally 2 years for an injury case. If the lawyer has failed to file a lawsuit within the two year time limit, your claim is now against the attorney for legal malpractice. Find out if a lawsuit has been filed by asking your attorney or asking the clerk at the county courthouse. If you have stopped medical treatment, your attorney should either settle the claim now or file a lawsuit and let a jury decide what your damages are. I hope this was helpful. Saul Ferris, Esq.

I do not believe you can find a satisfactory answers here.

You should send your lawyer a certified mail requesting detailed status of your case. Ask all the questions you have--make sure you are pleasant and not accusing him of not doing any work. Just ask the questions you have and give him 30 days to respond. If he does not--get another attorney.
