You cannot sue the individual in Illinois unless the individual "resides" in Illinois or can be served with a summons here. Generally, you can only sue an individual in the place where that individual resides, or in the place where the incident occurred.

In Illinois, an action may be brought in the county where the defendant resides or the county where the transaction or event occurred out of which the cause of action arose. Accordingly, you could sue this individual in an Illinois court only if the individual resides in Illinois. However, U.S. federal courts permit actions between citizens of different states, and depending upon the jurisdictional facts and circumstances, you might be able to file in an Illinois branch of the federal court.
