Legal Question in Personal Injury in Illinois
Unwanted Credit Inquiry
A personal banker from Chase Bank, asked me to switched from a Regular Visa Card to a ''FREEDOM CARD'' so I can earn Points and cash back. Before I accepted this offer, I asked her several times if this would incur a CREDIT CHECK and she confidently replied ''oh no, this is just a transfer, no credit check would incur''. So I went ahead and answer all the Personal Questions(ss,income, assets, etc) she asked. That same day, I received a call from Chase asking the same questions, I did not finish the call because I was busy. A week later, I got a letter that I was denied of a Master Card Application. THE MANAGER OF THE BRANCH HAVE APOLOGIZED AND SAID THEY CANNOT DO ANYTHING ABOUT THE CREDIT CHECK. THE BANKER PROVIDED ME WITH FALSE INFORMATION ABOUT THE FREEDOM CHASE CARD AND THEY HAVE ME APPLIED FOR A CREDIT CARD WITHOUT MY KNOWLEDGE!!! NOW I HAVE AN EXTRA CREDIT INQUIRY WHICH I DID NOT CONSENT TO. CAN I PURSUE LEGAL ACTION AGAINST THIS BANKER?

Re: Unwanted Credit Inquiry
You can--but how much are you willing to spend on retaining an attorney to pursue it.
Generally, you should be looking at about $5000 initial retainer and then an hourly rate without really having any guarantees that you will prevail in the end--or if you do, you will get anything in terms of monetary value.
I hope this helps,
