Legal Question in Personal Injury in Illinois
walmart accident, no injury
I was shopping at a local Walmart store with my 11 month old son. He was in his stroller. We were in a clearance aisle where everything is thrown in on the shelves. As another customer was walking by I moved the stroller over to one side of the aisle so she could pass. The customer saw something of interest to her on the shelf across from my baby and stroller. she removed a large box from the shelf which knocked over a large metal shelf that was standing on end on the floor propped at an anle against the corner of the box and a shelf attached to the wall . Neither I nor the other customer saw the shelf leaning until it was falling over. Anyhow, the shelf fell over and hit my baby in the head, which resulted in a large lump on his head and he appeared fine, simply scared. I took him to the ER where they said he had no injuries and the lump had dissappeared . The compnay offered to pay the medical bill and compensate for the ''Pain and Suffering''. Should I accept whatever they give me because my son has no injury, or can I negotiate with them on the amount or should I hire a lawyer to try to get better compensation? They have already admitted negligence on their part during a recorded conversation

Re: walmart accident, no injury
DEAR SIRS:
YOU HAVE A CASE. IN ANSWER TO YOUR QUESTION, WHETHER YOU SHOULD ACCEPT THE SETTLEMENT DEPENDS ON WHAT THE PHYSICIANS SAY ARE THE NATURE AND EXTENT OF THE INJURIES.
A HEAD INJURY REQUIRES GREATER COMPENSATION THAN JUST MEDICAL BILLS.
YOU'RE ENTITLED TO PAIN AND SUFFERING, AND IF THERE IS A SCAR, DISFIGUREMENT.
PLEASE CALL SHOULD YOU WISH TO DISCUSS.
MANY THANKS.
