Legal Question in Personal Injury in Illinois
My wife was involved in an auto accident (rear ended) that was not determineed her fault. Our auto was totaled and we have a balance on our loan that the totaled amount does not cover. We now have no vehicle for my wife to go to work in, no finacial means to pay off current loans balance, and due to financial history are not able to get financed for a newer auto. What legal action can I take against the person that caused the accident, her insurance, etc?

Unfortunately, if the other company has offered the value of the vehicle, there is nothing that you can do regarding the property damage to your car.
You are entitled to the value, not the amount due. You are also entitled to compensation concerning the loss of use of the car for the period of time between the accident and the date that the total occurred.
