Legal Question in Personal Injury in Illinois

I was just wondering if I would have a good case to sue...here is what the press released about my accident...

CHAMPAIGN � Two people from Champaign were injured, one seriously, when the van they were riding in was hit by a train in north Champaign Monday night.

A release from Champaign police spokeswoman Rene Dun said about 10:27 p.m., officers were called to the 200 block of East Bradley Avenue where a van and a train collided on the railroad crossing just west of North Oak Street on Bradley.

The lights were flashing and the arm was down as Ronald Roark, 18, approached the crossing. As the arm began to go up, he drove forward even though the lights were still activated. As he went forward, the crossing arm started to lower again and a southbound Amtrak train struck the van.

The impact of the collision spun the van. Both Roark and his passenger, Tatiana Roark, 22, got out and called for help.

Both were taken to Carle Foundation Hospital. The release said Ronald Roark was alert and providing information to police while Tatiana Roark appeared to have suffered severe injuries. She remained at Carle Tuesday morning in serious condition while Ronald Roark was treated and released.

Dunn said there were no reports of anyone on the passenger train being hurt.

The accident remains under investigation.
