Legal Question in Product Liability in Illinois

Bruno Stair Chair

We had a Bruno stairchair installed in Dec 2000. Immediately we started having problems. They replaced the carriage and once again we started with problems again. Last Dec. we replaced batteries and belts. In June we had 6 bearings replaced. The chair was so lovely and quiet. Now Aug 2, the ''squealing'' is back and very loud, embarrassing us when we have company and irritating us when we don't. We complained to Bruno. Now they want to completely replace the track and carriage but want us to sign a release for any further problems. We paid $3,600 and have had nothing but problems. We need this stairchair as my husband has lost his balance system and it not safe for him to walk up or down stairs, he is 78. I am 65 and since 2000 have had problems with my legs and feet. Now I have been diagnosed with post polio so soon I could become dependent on that stair chair to get to our upper level. This has allowed us to stay in our lovely two story home which we have adapted to our retirement needs. We would hate to have to leave our home. Should we consult an attorney, should we just let them reinstall the track and stair chair and take our chances, or should we just put up with this awful squealing - it was so nice and quiet afterrepair

You should consult an attorney who will be able to take a look at the original sale and repair contract to see whether you are obligated to sign the release. It appears highly unusual to me for Bruno to ask you sign a release specially since the chair has given you nothing but problems.
