Can I sue sears? I was purchasing an item and the cashier offered me a discount by applying for a credit card. I asked her will I get charged for this service. She said no and off course I applied and got a discount. But few week latter I get home billed for about 59 dollars for annual fee. So can I sue them? If so how much I can sue for because the purchasing value was about 12 dollars.

Of course you can sue them. You can sue them for whatever amount of your damages for the misrepresentation they gave made to you. But, first you have to be able to prove that the cashier told you what you say she did. You know she will deny having said anything of sort to you- so you have to figure out how to prove your case without her testimony.
Once you figure this out, you can go to the Court house nearest to your house, and file a complaint. The fees to filing is about $200--approximately, I do not recall exactly what the fees are for small claims. Once you have filed your case, then you will have to appear in court and prove your case. You better brush up on Illinois Law cause Sears will probably defend the case.
