Toxic Injury

My question is: If I sue my former employer for Toxic Injury, can they discontinue my retirement pension, and my health care benifits?

The short answer is that NO, they should not. You paid for those benefits throughout your career, and they should not be subject termination because you pursue legal remedies on another issue.

I am assuming here that you are now retired. If you still work there, yes, you can be terminated- not for suing the company (at least, it can't look like it is for suing the company.) In Missouri, injuries caused by employers are subject to Workers' Compensation law, not civil law generally. There are time limits for reporting an injury after it is discovered under workers' compensation.

If the product that injured you was produced by another company, you may have a civil suit against them. I would advise you to speak to a trial lawyer whose practice includes both workers' compensation and civil litigation.
