Association not disclosed

Hi, we bought a single family detached home in Dec 2005. At the open house, I asked the seller's agent if there was an association. (By the way, this agent lives next door to the house for sale) The agent flat out said that there was no association.

We bought the house and closed, and no association docs were ever provided.

Three years later, I recieved a letter from one of the neighbors regarding a special assessment. She also notified me that I am in an association and provided a copy of the Declaration.

The Declaration does state that my home is part of an association.

What recourse do I have with the seller or the agent who concealed this fact. Also, I find it hard to believe that she would not know since she has lived there since the subdivision was built.

Was the seller required to produce those documents pursuant to the contract? How were you damaged by the misrepresentation? What benefits and services are provided? Was the declaration recorded and public record? Please repost to LAwGuru with additional details
