Legal Question in Real Estate Law in Illinois
My Association is in possession of my unit for late assessment fees. In Illinois they can possess the property for 13mos before returning to the unit owner. The Association has refused to return possession to me. What can I do to force the units return.

The question is whether they have repaid themselves what you owed them. Length of time per se is not the factor. If they have repaid themselves, however, they should return possession to you. It may be encumbered by the remainder of a lease, but you would be entitled to residual rent until the end of the term.
