Legal Question in Real Estate Law in Illinois

Auto Lien

I am half owner of a vehicle that is in my ex's posession. Can I put a lien on it to get the money I paid into the vehicle? If so, what is the process and legal venue for this?

Thank you.

Re: Auto Lien

Since it is your "ex" is that ex wife or ex girl friend. If it is wife what does the divorce decree say. If it is girl friend might be even more difficult. But in either case to impress a lien on a vehicle in Illinois you need the title so that the lien can be placed on the face of the certificate of title otherwise the lien is no good. Can you get the title from your "ex"? Good luck!!

I would have to add that it would not be the money that you put into it but the value of the car now. Either way, I am not sure how easy it would be to obtain the title to do so.
