Bank fraud bank kept my money which should of been returned to me

In December of 1998 I sold a house in Michigan, I am a resident in Chicago, IL. Upon closing the closing company First American Title Insurance received a statement of Loan Payoff from the Mortgage Company Standard Federal Savings. Which they paid, the statement showed taxes due which were also paid at that time by First American Title Insurance Company. After closing and payoff, Standard Federal Saving paid the taxes again and deduct from my Escrow Accounts ss a result shorting me $407.06 from my escrow. The taxes were paid to the City of Owosso and when they received the duplicate payment from Standard Federal Saving they return the check to them. This money was taken out of my Escrow Account which I paid into and the money should have been returned to me. Standard Federal refuses to return my money. I been trying to work this issue with the comptroller Office of the Currency. They said there is nothing they can do.

My questions is can I take this to small claims court? where would I file Or what legal avenues should I take to get my money? I am unemployed and can not afford an attorney.

Why don't you file a written complaint with the Michigan Dept. of Insurance??
