Legal Question in Real Estate Law in Illinois

Hi! I bought a condo 3 years ago, and have noticed cracks forming in the wall and ceiling within the past year. My condo unit is on the 3rd floor, and I believe the entire condo building is sinking into the marsh/swampy ground. The condo association board of dir. and the management company have already shown negligence to general maintenance and I fear they would take no responsibility. Can I legally hire an independent building inspector and then file a claim directly to the condo associations' insurance policy? Or must I legally go through the condo's board of dir./management company? I want to start this process out on the right foot and greatly appreciate your advice.

You need to read the condo association bylaws and look for any rules regarding a sutuation such as this.

If you cannot still find an answer, consult with an attorney with condo association rules in hand.
