Bounced check, not paying rent

A tennant with a lease bounced a check in Oct to me, he states he has proof his account was debited but wont provide it, I was never credited. He refuses to pay Dec rent and says he is moving and that I broke the lease by giving him a 5 day notice. I gave the notice for 2 months rent due. Did I break his lease. I wont be able to rent it in Jan, and maybe Feb, its to cold out nobody moves. Should I take him to court for 2.5x the amount of the bounced check and the time the apt is vacant, he signed a lease till 8-08

You have an obligation to try to rent the place once he leaves. You can sue for rent owed until you are able to rent the place, the expenses and costs onvolved in having to lease it early, including heat so that the pipes do not burst and all fees allowed for the bounced check.
