Legal Question in Real Estate Law in Illinois
My boyfriend and I are both owners of our home 50/50. Not even a year into our home he found someone else. I ended up being the one to leave staying at a friends to get away from the verbal and physical abuse. I felt he should have left since he made the choice. At the last minute, while doing the refi, he said he wanted to work it out leaving me on the deed and not the loan. Now he wants to sue me for a partition law suit to get me out. What is he going to sue me for?? The first month i came back I still owed my friend from living there and he said it was ok. The second month was the refi so no payment there. The third is this month and I am paying a third. I wrote him a check. He says he will sue me for not paying. I am not on the loan.

It is hard to give advice in a forum like this for a situation that would require clarification and a review of the documents, but it sounds like advantage is being taken and an attorney could help you turn the tables. That does not mean that either of you are likely to come out ahead, but you need to stop the bleeding. Stop the nonsense from going further and further before the complications and costs just make it more and more problematic.
