Legal Question in Real Estate Law in Illinois

boyfriend doesnt want to sell

I'm not sure how to help my daughter. she purchased a condo with her boyfriend a while ago. Now she wants out of the relationship and the condo, he doesnt want to move out or sell. Neither can afford on their own or would qualify for a new morg. How does she force him to sell, or what legal recourse does she have and what type of attorney would she see.

Typically, a partition suit is filed. Your daughter's situation is typical in non-married "relationships". That said, a partition suit would not be "cheap". It would be better for both to place the property for sale, even in this "slow" market. Failure to pay can result in a foreclosure action, and that would be bad for the credit of both. Good Luck!

File a partition action, be willing to pay more for his half than for your half.
