Legal Question in Real Estate Law in Illinois
How do I change the name on a deed
My father and I own a house as joint tenants. He has since passed. Do I need to change the deed to my name only? And if so, how do I go about doing that?

Should not be necessary. When you sell or refinance the property, you probably will need to sign a joint tenancy affidavit, which your attorney can prepare for you at that time.

I agree, it's not necessary that you have the property put in your name right now. However, there are some benefits for doing so, namely that in the event of your death, it makes the transfer to your heirs a bit easier. But again, it's not necessary. If you decide to do it, your attorney can prepare the requisite paperwork for you.
