Depending on the practice in your county, it could be done by a "small Estates Affidavit" or by "Probate"/ in either case it will neccessitate hiring a lawyer to perfect the title to the real estate in the legitimate heirs name.

Transferring real estate out a deceased owner's name cannot be done with a small estate affidavit. Generally, a probate estate should be opened to do this, although some title companies will allow a bond in lieu of probate (but there is an additional title fee associated with this). Feel free to give me a call at (847) 991-2250 to discuss.
