Legal Question in Real Estate Law in Illinois
City sewer clog...House flooded
In Sept, our home flooded.
We are situated with many sewer openings in front, a storm pipe that runs underground next to our home and runs in a storm system that runs through a gully that begins at the end of our back yard. The system was clogged, filled up, the sewer cover in the gully EXPLODED, leaving destructed concrete manhole cover. After this the water no longer flooded our home, but ran overland wound up flooding homeowners further down the way (with the gully as their backyard). The cover was witnessed exploding the night of our flood by 12 yr old son...but we didn't really hear him, as we were busy dealing with our flooded home. Over a week later the city pulled a clog out of the system that city workers mentioned ''released water from the whole neighborhood''. After repeated calls, the city sent out the engineer who discussed upgrades that could be made to ensure this didn't happen again. In the mean time, the city disregarded our claim of approx. $15,000 sent mid December. We were recently told by the ''engineer'' that the city's insurance leaves these decisions to the city...and he doesn't feel this was caused by the clog. Any suggestions are appreciated. April

File with your homeowners insurance carrier. If covered, you can recover quicker and the insurer can go after the city.
