Legal Question in Real Estate Law in Illinois
Closing Problems
I am selling my house and I did not hear from my lawyer or real estate agent about our closing date until three days before. I had informed my lawyer that I was unable to make the date due to lack of notice and if it could be changed to a date next week. I couple of days later the buyer was still under the assunption that the closing was on the date that was not good. When my lawyer was contacted they said that the day could not be changed so the buyer signed her papers and I was to sign mine the following week. In the meantime I was supposed to pay three days of rent to the buyer even though I never agreed on a closing date and I never signed any papers. Is there something wrong with this?

Re: Closing Problems
Depends on what your purchase agreement says. Does it state a closing date? Most purchase agreements specify that the closing will occur on or about a certain date. Does the purchase agreement state who will schedule the closing? It is common for the buyer's lender to schedule the closing. Perhaps the buyer's interest rate lock was expiring. Sometimes there is not much notice, but the approximate closing date should have been included in the purchase agreement.
