Legal Question in Real Estate Law in Illinois

Co-borrower wants out of mortgage responsibilty.

Here is my situation. I own and share a home with a same sex, ex-friend who abuses alcohol. I would like one of three things to happen. 1. Sell the home to equally spilt the loss and or procedes..2. eliminate my obligation to our mortgage so I can move out to obtain a place of my own...or 3. have his obligation removed so that he can move out and obtain a place of his own. Here is my dilemma, this person refuses to place the house on the market because he recently filed C7 Bankruptcy and claims he cannot do anything until his bankruptcy is discharged. He has also refuses me a buy out offer. What can I do?

Regardless of his pending or filed bankruptcy, you can bring a partition suit in the county where the real estate is located, have it sold and divyied up ect
