Legal Question in Real Estate Law in Illinois

Condo Assessment Judgement

I have a judgement against me for condo assessments owed. Of the total balance due...a third of the amounts owed is legal fees.

Do I have any recourse?

Make an offer to settle with a lump sum payment if you have the money Often, a creditor will give a discount, sometimes as much as 1/3rd off.

Re: Condo Assessment Judgement

In theory, you could go in for up to a year after a judgment is entered; it's called a 2-1401 Petition. Realistically, you have a much better chance going in within 30 days on something called a 2-1301 Petition (or Motion).

But short of that, the legal fees have been approved by a judge. So I can't think of anything else you could do. On the other hand, depending on what has happened with the property, a buyer of a condo (at a judicial foreclosure auction, for example) would potentially be responsible for 6 months of the assessments. So I think that would be a set-off for you. But I don't know if that's your situation.
