Condo Floor Reinforcement/Repair
I have a 2nd story condo and the floor is sagging. A structural engineer made an initial inspection and determined either the joists holding up the floor are sagging, or the subfloor underneath my unit floor is the problem. In each case, who pays the cost of repair/reinforcement: me, the unit owner, or the condo association (all owners)? There is no unit below me. My unit is partially over a common hallway/lobby on the ground floor. The rest of the unit is above the basement. I understand the roof to be a common element, but am not sure about the floor structure under/between the units. I have some heavy furniture, like bookcases, but have not, as far as I understand used the unit for anything other than its intended purpose - normal occupancy. I had this furniture with me in another apartment for 13 years, with no floor problem. Even if this is normally the responsibility of the association, I'm concerned the board will try to say I caused it through negligence of some kind.

I would say that the problem arises in the common element. This should be confirmed via your structural engineer. I would enjoy seeing his/her report. You are going to need a lawyer, and it ain't goin' to be cheap.
