Condo Special Assessment
Hi -
In 2005 I started paying monthly for a condo special assessment.
The condo mgmt. said they were changing their billing/computer system; and generated many errors. Because of these errors I decided to pay the total bill. I paid the amount the told me to retire the bill.
In 2005 I received a letter from the mgmt., telling me as a result of an INTERNAL AUDIT they decided I owed an additional $470.40.
I contacted them, protested, they wouldn't call back, blah, blah. Various condo authorities said they couldn't see how I owed this; but I could never get it in writing.
In 2008 we got a a new mgmt co. We continued discussion. Because of the time this was consuming in my life- I paid the $470.40 (still don't think I owe it) and asked for a correct bill. I was then I was told it was too late. This had become a legal matter and now I am being asked to pay an additional $1200.
Is it legal to come back to a consumer 5 years after a bill has been paid to say that the payout fee the CONDO MGMT AGREED to was not sufficien? Was I a fool to actually pay the $470.40, which I don't think I owe since it was the amount THE MGMT STATED I OWED. Do I owe the $1200.00 in legal fees????

It's impossible to tell based on what you said. I would wait to see what they do and then explain everything to a judge if they sue you. Or be proactive and threaten to sue the management co. for "slander of credit" if they persist. But you'll probably need to hire a litigation attorney to actually do that.
