Legal Question in Real Estate Law in Illinois
Condominium building suffered severe foundation damage caused damage to my interior door drywall in concrete interior floor, who's responsible
1 Answer from Attorneys
The condo should have its own insurance, and you should have yours. So initially this should be an insurance issue. And it depends on what was damaged: common elements, or the unit. You may think it's the "unit" but it could be common elements (including limited common elements). So someone will have to review the condo declaration and survey in particular. Assuming the foundation is a common element (seems likely) and its failure caused unit damages, then it will come down to whether the declaration and the insurance policies require the association to handle all repairs or whether you have to apply to your own insurance for unit damages while the association makes a claim for common elements damages.
