Legal Question in Real Estate Law in Illinois
The County has cut trees on our proprety down.
Hi, The problem is that we live next to a bike trail. Last week the County or people who maintain the bike trail, cut down 1 tree that may or may not be ours and maimed another which is ours for sure. The man we were talking to has stood us up and not returned phone calls. I've contacted different govt. agencies like the states attorney but they are rude and hang up saying that they represent the county and find a private lawyer. I'm persussing it out of prinical. I mean if I was bothered by my neighbors tree and I went there and cut it down that would be tresspasing and vandalism at the very least. It's 2 20 year old oak trees. The only for sure ours have a small survial rate due to the way it was hacked up. What can I do? Can I press charges crimanially? Do I have no rights to any help from the state/county/city? I don't have to have fiancial comp. but another tree like that one would be great although impossible. They didn't warn or ask. Any feedback appreciated! Thank you.

Actually, the state's attorney is correct. You need a private lawyer. You should contact one who practices in the county where you live. The county or any gov't agency, for that matter, can't take property without due process and just compensation.
