Criminal Activity in Apt. Complex
Is it possible to break a lease due to suspected illegal activity in our apartment complex? I have had to call the police numerous times in the last few months to report suspicious individuals actually hiding in and around the parking lot and building (Both non-tenants and one specific tenant). It is suspected by Management that there is some drug dealing going on with this tenant, however they say there is really nothing they can do about it except to have the individual questioned. Management has had other complaints about drugs with that individual. I am scared to leave the building without an escort due to the nature and amount of the activity (individuals hiding between vehicles and behind trees, etc.) We want to move out now into a safer area, but the Management says they will either sue us OR make us pay a hefty fine.

It's really impossible to conclude whether a constructive eviction has occurred from what you submitted. Also, to make a conclusion, one would have to examine your written lease. You should make an appointment with an attorney to review the situation and the written lease. Good Luck.
