Legal Question in Real Estate Law in Illinois
Our current home is in my fathers name, but my mother makes the payments under her name, we are trying to sell the house at the moment, but my father no longer lives in the country and the house is still in his name what can we do to sell?

Your best course is to get closing documents and a power of attorney out to your father to sign as promptly as they can be prepared once the details of the transaction are known. There will be various details that need to be addressed (e.g., direction on how to pay proceeds; overseas notarization, ...). Discuss all this with a real estate closing attorney in the Northern Illinois region. If handling it as suggested above is going to present issues, address that immediately so that a decision on the best course can be evaluated and steps taken as promptly as possible so as not to delay or defeat a closing.
