Legal Question in Real Estate Law in Illinois

deed

My fiance bought a house and says he cannot put my name on the title/deed because my debt would interfere with financing - he bought the house 2 years ago and we live together and I pay half of monthly house payment.

Re: deed

You did not ask a question. However, if you're wondering whether your fiance is a scoundral and simply trying not to put your name on the deed, you should know that his explanation makes sense.

If you had poor credit at the time of the purchase, he might not have been able to obtain mortgage financing to purchase the home with you as an applicant. If that were the case, you couldn't be on the deed. If he now added your name on the deed, it would run afoul of provisions of the financing agreement -- probably constituting a default and making the entire loan accelerated to be due & owing immediately.

So, while he might be a scoundral for other reasons and, indeed, maybe even this one, his explanation at least seems reasonable.
