Legal Question in Real Estate Law in Illinois

easements

Is there any time limit on land easements? In 1996 we purchased land. The land next to us is landlocked and the owner has come to us with a copy of an easement from 1923. When we purchased our land we were not aware of this easement. He is now wanting to build a road on said easement. Can we keep him from doing this?

Re: easements

Easements of the type to which you refer run with the land, forever, unless vacated by the person or entity having the right to the easement. You knew about the easement; it is in the chain of title, thus notice to the world. You will probably not be able to prevail if you try to stop the holder of the easement from building a road. Didn't you have a lawyer at the time of your purchase?
