Eviction

Hello,

I have lived in my townhouse in IL for 4 years. Upon moving in my name and my husband's name were on the lease. 1 yr later we divorced and his name was not included on the new lease (this was in 2005). Since then I (and my 3 children) are the only names on the lease each time it has been signed. Late in 2005 I started dating someone who moved in, early 2006 he changed his DL to my address and now that the relationship is over he refuses to move out even though I have given him numerous verbal notices (15 and 30 days at a time). I would like to file something in court but am not sure who I would be in the suit? The landlord or the acting property management agent? I really would not like to involve my landlord since this person is not on the lease so how do I go about filing the paperwork and what pleadings/paperwork do I file and in what order?

You need to give him a thirty day notice to quit. It will be valid for May 1.

If he does not leave then you can evict him.

I agree with Attorney Micholetti. give him a thirty day notice and have someone over 18, not related to you give it to him.
