Legal Question in Real Estate Law in Illinois

I am the executor of my deceased fathers estate. There were some time share properties that need to be distributed to each of the siblings, these are in a trust that I am in charge of . I don't know where to go from here ? I want to distribute them so each sibling has the weeks in their names and is responsible for their own obligation.

This is simply going to involve busy work. Contact the manager of each time share to inquire about the processes they would like you to follow to get the necessary tasks accomplished on their books. You may find you have to keep pressing to get to the right person and the correct information. If they provide any guidance on a website, that would be helpful, but don't expect it. I would note, if the time shares are not worth having, now may be a good time to be rid of them. Many time share owners regret the purchase and find them hard to sell. Each recipient should consider whether it will be in their best interests to accept them.

I agree with Mr. Repay assuming everything you say is accurate, because without seeing the documents you are working from, no advice can be reliable. For instance, you say you are the executor, but trusts have trustees, not executors. So was this trust set up by the will? Which is it? If the will set it up, maybe the trust intended that each sibling wind up with his/her own trust with one of the timeshares as the asset, so that it can more easily pass from generation to generation.... So while you should find out from each time share management company their procedures for transfer, and see an attorney to make sure you're doing the correct thing. PS If the timeshares are say in Wailea or Kapalua on Maui, for example, maybe there's worth dealing with.....
