False Marital Status on Mortgage Documents
My husband purchased a home in his own name, citing I my own mortgages (mine and our joint for his mother's home) made doing so together unfeasable. I signed the homestead agreement and that was cited on the deed. We lived together in the home for 6 months. During marital problems, he refinanced behind my back removing $25k of equity from the home, applying for the mortgage as a single person which was granted. Is this legal?

I'm not sure I understand the first part of your question, but in general if a person misrepresents something important (including their marital status) on loan papers, that is considered loan fraud.

If your husband represented that he was single, he committed fraud.
