I took a new job and relocated 125

miles away. We were not ready to

sell the property, so my brother-in-

law stayed there for a year. We had

a verbal agreement, and he paid no

rent. We had to ask him to leave

because he was ruining the place. I

have a rent to own agreement with

new tenants since August 06. My

brother-in-law has left his unworking

(and now no valid plates or

insurance) car in the garage since

April 06 and refuses to move it. The

tenants have asked for it to be

removed several times and he

continually misses deadlines to do so.

I have run out of time and need to

do something quickly? What can I

do? I would tow it out to the street,

but I am told I would be liable for

fines, etc.. I suspect he is waiting for

me to move it, or do something at

my cost for his benefit.

According to Illinois law, you must contact your local law enforcement - they will tow the vehicle for you - you should first get a letter to the owner allowing seven days to pick up the vehicle - I would send this letter certified mail with proof of receipt - keeping paper trails is important - the local law enforcement will then wait seven days and will tow it - they may charge a fee for this.
