Legal Question in Real Estate Law in Illinois

My father died and didn't leave a will and left a house that still has a mortgage. How can I legally obtain the house to possibly sale the house when I'm not able to make the payments?

The heirs to his estate should be able to make payments, and sell the property. You should contact an attorney in your area to assist you.
