Legal Question in Real Estate Law in Illinois
My father recently passed away and owes $4500.00 on the home he was purchasing contract for deed, it is currently 2 months behind on payments, my name is on the deed as well and I am offering the seller the remaining balance on the contract, but she says it could be weeks before we can get the papers signed and by then the payments would be over 90 days behind, I am worried she might try to file for a breech of contract what should I do

Hire an attorney. If the contract gives you the legal right to get the deed and the contract has the proper provisions (acceleration on death....) you SHOULD have a right to fulfill the contract. There are other protections for someone who owes little on land sale contracts, but without reading the entire contract it's impossible to say. HIRE A LOCAL ATTORNEY NOW!!!!!!!!
