can I file a motion to have the mortgage company produce all recorded phone calls from date of re-finance to last time we spoke with them to prove we believed the mortgage was illegal from the very beginning

It's called a subpoena duces tecum meaning a subpoena for documents and records.

Sure, you can request those documents. If they are a party to the lawsuit, a Motion to Produce or Request to Produce needs to be used. If a non-party, the Subpoena mentioned by Stephen is needed.
