Re: How do you fill out Power of Attorney papers

I think the most general answer is "very carefully."

There are several often-used 'stationery form' versions of the power of attorney, including the truly general-purpose Uniform Statutory Form Power of Attorney, durable powers of attorney, etc.

In addition, attorneys sometimes draft specialized powers of attorney, and there are standardized power-of-attorney forms or language traditionally used in certain industries, e.g. a common carrier may appoint a trade association its attorney in fact to publish tariffs.

So, there isn't any standard answer. I strongly suggest you consult an attorney to make sure you are using the right form, that granting a power of attorney is suitable for you, and that the form is correctly filled out and notarized.

In California, there are many statutory provisions affecting the wording, execution and use of powers of attorney. If you want to read more, refer to Probate Code sections 4000 through 4545. This is a lot of law, but the chapter and section headings are reasonably clear and thus pretty helpful in finding sections of interest.

Most public libraries have the Codes, or try on line.
