That is a tricky question.
You need to review the terms of the agreement that you signed.
This is happening a lot lately and the law firms representing developers/sellers are fighting for that money.
There is usually an attorney review period and some other dates contained within the contract pertaining to just this.

It depends entirely on whether you have a financing contingency in your purchase agreement.
