Legal Question in Real Estate Law in Illinois

Force sale of real estate

When three people own real estate joinly (parent, step-parent and child relationship) and two of the three people wish to remove themselves from the commitment after 6 years and the third person's(child) credit is in too bad of shape to stand alone, can the two people (parents) wanting out of the commitment, get a court order to force the sale of the property? What are our options?

Re: Force sale of real estate

An attorney would need more specific information in order to provide competent legal advice. Do these people own the real estate as joint tenants with rights of survivorship? Or, do the three of them own it as tenants in common? Or, do the husband and wife own one half as tenants by the entirety and the other owner own one half as a joint tenant or as a tenant in common? Each possible scenario may have different legal consequences, and may require a different legal solution to the problem. If you would like to discuss this, please call me for a free telephone consultation at 314-727-2822. If I am able to help, I will quote you a modest fee based upon the amount of time and effort required.
