Foreclosure Process in Illinois

I was hearing that the foreclosure process in Illinois is about 12 months from the point you miss your 1st payment to the point when you are evicted. But I also have been hearing that the courts are backed up in these cases and individuals are taking longer to lose their homes. Is that true?

Yes the whole process can take twelve months, even more depending on what you want to do.

Part 1: yes

In Illinois you have to miss -two- payments before an action in foreclosure may be filed. After the action is filed it can take six to seven months if the property is owner-occupied, 5- 6 months if rental and one month if abandoned. Eviction takes another 30 days.

Part 2: maybe a bit.

I work with defendants in foreclosure and things seem to be moving right along. This is mostly because almost all defendants don't fight the foreclosure or even file an appearance.
